The purpose of this Privacy Policy is, in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (hereinafter “General Data Protection Regulation” or “GDPR”) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and with national legislation, namely Law no. 58/2019, of August 8, which ensures the implementation of the GDPR in the national legal system. Transmission of Personal Data and Recipients

The personal data processed, in addition to being communicated to official entities in compliance with a legal obligation, may also be processed by entities subcontracted by Alecrim, whenever legally required or contractually necessary, and only the data necessary for the execution of the required service will be provided to these entities.

Alecrim ensures that the subcontractors it uses provide sufficient guarantees for the implementation of appropriate technical and organizational measures for the processing of personal data in accordance with the GDPR and that they are able to defend the rights of data subjects.

In compliance with a legal obligation and for the purposes described, personal data may also be transmitted to judicial, administrative, supervisory or regulatory authorities.

Rights of Data Subjects

The data subject has the right to:

– Request from the Data Controller access to their personal data, its rectification, erasure or restriction of processing;

– Object to the processing of their personal data;

– Receive the personal data concerning you that you have provided to a Data Controller, in a structured, commonly used and machine-readable format, and request data portability to another Data Controller, if this is feasible and technically possible;

– Withdraw the consent given, at any time, when the processing is based solely on that legal ground;

– File a complaint with the Supervisory Authority, in this case the National Data Protection Commission – CNPD.

To this end, the data subject must send their request in writing to the email address info@alecrimrealesate.com.

The data subject may also request any more detailed information about the processing of personal data, as well as submit complaints about the way in which their personal data is processed, without prejudice to the right to also submit a complaint to the National Data Protection Commission.

Security of Personal Data

Alecrim adopts the appropriate and necessary security techniques and measures to protect the personal data of the data subject, protecting it against misuse or unauthorized access. Alecrim treats the personal data it accesses in an absolutely confidential manner, in accordance with its internal security and confidentiality policies and procedures, which are periodically updated as necessary.

Minors

Minors may not use the services available through the website without the prior authorization of their parents, guardians or legal representatives, who will be solely responsible for all acts carried out through the website by minors under their charge, including filling in the forms with the personal data of said minors.

Breach of personal data

In the event of a data breach and insofar as such breach is likely to entail a high risk to the rights and freedoms of the data subjects, Alecrim undertakes to report the personal data breach to the data subjects as well as to the National Data Protection Commission within 72 hours of becoming aware of the incident.

This Privacy Policy, which also forms an integral part of the General Terms and Conditions of Use of the website, may be amended at any time, without prior notice, by publishing a new version on the website, with express reference to the date of the last update.

Applicable law and jurisdiction

Any disputes arising from the validity, interpretation or execution of the Privacy Policy, or which are related to the collection, processing or transmission of personal data of its owner, must be submitted exclusively to the jurisdiction of the judicial courts of the district of Lisbon, without prejudice to the applicable mandatory legal rules.
